Terms of Service

1. Acceptance of Terms

By creating an account or using iducomm ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you ("Subscriber" or "you") and iducomm.

2. Description of Service

iducomm is a review management platform that enables businesses to send automated SMS and email review requests to their customers, collect star ratings and private feedback, and manage their online reputation. The platform includes campaign management, QR code generation, feedback analytics, and reporting tools.

3. CASL Compliance and Subscriber Obligations

You are solely responsible for complying with applicable anti-spam laws in the jurisdictions where you operate, including the Canadian Anti-Spam Legislation (CASL) and the US FCC Telephone Consumer Protection Act (TCPA).

By using iducomm to send messages, you represent and warrant that:

  • You have obtained express or implied consent from each recipient before adding them to the platform
  • Each message sent via iducomm relates to a genuine commercial relationship with the recipient
  • You will not upload contact information for individuals who have previously opted out
  • You will promptly honour opt-out requests through all channels
  • Your business identification is accurately represented in all messages

iducomm reserves the right to suspend accounts found in violation of CASL, TCPA, or other applicable anti-spam laws.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or messages to individuals who have not consented
  • Misrepresent your identity or business
  • Manipulate or fabricate reviews on any third-party platform
  • Harvest or scrape contact data from third-party sources without consent
  • Violate any applicable law or regulation
  • Interfere with the platform's operation or security

5. Review Gating Policy

iducomm is designed to be compliant with Google's review policies and FTC guidelines. The platform does not prevent customers from leaving public reviews regardless of their rating. Negative customers are always offered the option to share their feedback publicly. Subscribers may not use the platform to selectively solicit only positive reviews in a manner that violates third-party platform policies.

6. Subscription and Billing

  • The Free plan is provided at no cost with stated monthly limits
  • Paid plans (Starter, Growth, Pro) are billed monthly in advance
  • Prices are in USD unless otherwise stated at checkout
  • Subscriptions renew automatically unless cancelled before the renewal date
  • No refunds are issued for partial months; you retain access until the end of the paid period
  • We reserve the right to change pricing with 30 days notice to active subscribers

7. Free Trial

New accounts receive a 14-day free trial of paid features. No credit card is required to start. After the trial period, your account will revert to the Free plan unless you upgrade.

8. Intellectual Property

iducomm and its content, features, and functionality are owned by iducomm and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent.

You retain all rights to your business data, customer contacts, and feedback content. By using the Service you grant iducomm a limited licence to process this data to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, iducomm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that results obtained will be accurate or reliable.

11. Termination

You may cancel your account at any time through the billing settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation. Upon termination, your data will be deleted within 90 days.

12. Governing Law

These Terms are governed by the laws of your applicable jurisdiction. Canadian subscribers are subject to the laws of Ontario; US subscribers are subject to the laws of Delaware. Disputes shall be resolved through binding arbitration where permitted by law.

13. Changes to Terms

We may update these Terms from time to time. We will provide at least 14 days notice via email before material changes take effect. Continued use of the Service after changes constitutes acceptance.
